 1. GENERAL

Sawaaro ("Sawaaro", "we", "our", or "us") owns and operates the website, mobile website, and related digital platforms (collectively referred to as the "Platform"), through which it facilitates the sale of lingerie, bras, sleepwear, shapewear, intimate wear, and related products ("Products") to users of the Platform ("User", "Users", "you", or "your").

 1.2

These Terms and Conditions ("Terms") govern your access to and use of the Platform, purchase of Products, and rights and obligations arising from the use of the Platform.

 1.3

By accessing, browsing, registering on, or purchasing Products from the Platform, you agree to be bound by these Terms, our Privacy Policy, Return, Exchange & Refund Policy, Shipping Policy, and any other policies published on the Platform from time to time.

 1.4

If you do not agree to these Terms, you should discontinue use of the Platform immediately.

 1.5

This document constitutes an electronic record under applicable laws of India and does not require any physical or digital signature.

 

 2. ELIGIBILITY

Only persons who are capable of entering into legally binding contracts under applicable laws of India may use the Platform.

 4. PROMOTIONAL COMMUNICATIONS

 4.1

By registering on the Platform, placing an order, subscribing to communications, or otherwise providing your contact information, you expressly consent to receive transactional communications, order updates, customer support communications, promotional messages, newsletters, and marketing communications through SMS, WhatsApp, email, telephone calls, push notifications, or other communication channels permitted under applicable law.

 4.2

You may opt out of promotional communications at any time. However, we may continue to send service-related communications relating to your orders, account activity, returns, exchanges, refunds, or legal obligations.

 

 5. LICENSE AND ACCESS TO PLATFORM

You shall not:

* Use robots, scrapers, crawlers, or automated tools.

* Use the Platform for unlawful purposes.

 5.3

Sawaaro reserves the right to terminate or restrict access to the Platform at any time without prior notice.

 

 6. TERMS OF SALE

 6.1

The display of Products on the Platform constitutes an invitation to offer and not an offer for sale.

 6.2

Your placement of an order constitutes an offer to purchase the selected Product(s).

 6.3

An order confirmation merely acknowledges receipt of your order and does not constitute acceptance.

 6.4

A contract for sale is formed only when the Product has been dispatched and shipment confirmation has been communicated to you.

 6.5

Sawaaro reserves the right to refuse, cancel, or limit any order before dispatch for reasons including but not limited to:

* Product unavailability
* Pricing errors
* Technical errors
* Payment issues
* Suspected fraud
* Violation of these Terms

 6.6

Products purchased from the Platform are intended solely for personal use and may not be purchased for resale, commercial distribution, or other business purposes without prior written consent from Sawaaro.

 

 7. PRODUCT INFORMATION AND AVAILABILITY

 7.1

We make reasonable efforts to ensure that Product descriptions, specifications, pricing, images, and other information displayed on the Platform are accurate.

 7.2

However, errors, inaccuracies, or omissions may occasionally occur. Sawaaro reserves the right to correct any such errors without prior notice.

 7.3

Availability of Products may change without notice.

 7.4

Certain Products may be available only in limited quantities.

 7.5

In the event that an ordered Product becomes unavailable after an order is placed, Sawaaro may cancel the order and issue an appropriate refund.

 

 8. PRICING AND PAYMENT

 8.1

All prices displayed on the Platform are in Indian Rupees (INR) unless otherwise stated.

 8.2

Prices may change without prior notice.

 8.3

Payment may be made through approved payment methods available on the Platform.

 8.4

Sawaaro reserves the right to refuse or cancel any transaction suspected to be fraudulent or unauthorized.

 8.5 Pricing Errors

In the event of any typographical error, system error, technical malfunction, pricing discrepancy, inventory inaccuracy, or other unintended mistake affecting the price, availability, or description of any Product, Sawaaro reserves the right to cancel, refuse, or modify any order prior to dispatch, regardless of whether payment has been received.

 

 9. SHIPPING, RETURNS, EXCHANGES AND REFUNDS

 9.1

Shipping, delivery, returns, exchanges, cancellations, and refunds shall be governed by the respective policies published on the Platform.

 9.2

By placing an order, you acknowledge that you have read and accepted such policies.

 9.3

Due to hygiene considerations, certain products including briefs, panties, and other designated intimate products may not be eligible for return or exchange except where delivered in a damaged, defective, or incorrect condition, or as otherwise required under applicable law.

Sawaaro reserves the right to verify all return, refund, exchange, and cancellation requests before approval.

 9.5

Sawaaro reserves the right to refuse service, reject return requests, suspend accounts, restrict payment methods, or limit future purchases where abuse of return, refund, exchange, promotional, or loyalty programs is reasonably suspected.

 10.1

During the course of registration and use of the Platform, Sawaaro may collect and process certain information relating to you.

 10.2

The collection, storage, processing, usage, disclosure, and protection of such information shall be governed by our Privacy Policy.

 

 11. INTELLECTUAL PROPERTY RIGHTS

All content available on the Platform, including but not limited to text, graphics, images, logos, product descriptions, videos, software, designs, trademarks, trade names, and other materials ("Content"), is the exclusive property of Sawaaro or its licensors.

 11.2

No Content may be copied, reproduced, distributed, modified, displayed, published, transmitted, or otherwise used without prior written consent from Sawaaro.

 11.3

Unauthorized use of the Content may violate copyright, trademark, and other applicable laws.

 

 12. REVIEWS, TESTIMONIALS AND USER CONTENT

 12.1

By submitting reviews, ratings, testimonials, photographs, comments, feedback, or other content on the Platform or through social media channels associated with Sawaaro, you grant Sawaaro a worldwide, perpetual, irrevocable, royalty-free, transferable, and non-exclusive right to use, reproduce, publish, modify, adapt, distribute, display, and promote such content in any media.

 12.2

You represent and warrant that such content does not infringe the rights of any third party.

 

 13. DISCLAIMERS

 13.1

The Platform and Products are provided on an "as is" and "as available" basis.

 13.2

While reasonable efforts are made to accurately display Product information, colours, images, and descriptions, actual Products may vary due to screen settings, photography, manufacturing variations, and other factors.

 13.3

Sawaaro does not warrant that:

* The Platform will operate uninterrupted or error-free.
* The Platform will always be secure.
* All information on the Platform will be complete, accurate, or current at all times.

 13.4

Product images are intended for illustrative purposes only.

 

 14. USER WARRANTIES AND RESTRICTIONS

 14.1

You represent and warrant that all information provided by you is true, accurate, and lawful.

 14.2

You agree not to:

* Violate any applicable law.
* Upload harmful, offensive, defamatory, obscene, fraudulent, or misleading content.
* Introduce viruses, malware, or harmful code.
* Impersonate another person.
* Interfere with the operation of the Platform.
* Attempt unauthorized access to systems or data.

 14.3

Any violation may result in suspension or termination of access to the Platform.

 

 15. INDEMNIFICATION

 15.1

You agree to indemnify, defend, and hold harmless Sawaaro, its affiliates, directors, employees, agents, and representatives from and against any claims, losses, liabilities, damages, costs, and expenses arising from:

* Your use of the Platform.
* Violation of these Terms.
* Violation of any applicable law.
* Infringement of any third-party rights.

 

 16. LIMITATION OF LIABILITY

 16.1

To the fullest extent permitted by law, Sawaaro shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from the use of, or inability to use, the Platform or Products.

 16.2

Sawaaro shall not be responsible for delays, interruptions, data loss, unauthorized access, cyber-attacks, technical failures, or other events beyond its reasonable control.

 

 17. ACCESS OUTSIDE INDIA

 17.1

Sawaaro makes no representation that the Platform is appropriate for use outside India.

 17.2

Users accessing the Platform from outside India do so at their own risk and are responsible for compliance with applicable local laws.

 

 18. TERM AND TERMINATION

 18.1

These Terms remain effective until terminated.

 18.2

Sawaaro may suspend, restrict, or terminate your access to the Platform at any time if you violate these Terms or engage in unlawful activity.

 

 19. FORCE MAJEURE

 19.1

Sawaaro shall not be liable for any delay or failure in performance resulting from causes beyond its reasonable control, including acts of God, natural disasters, pandemics, governmental actions, strikes, supply chain disruptions, cyber incidents, or telecommunications failures.

 

 20. WAIVER

 20.1

Failure by Sawaaro to enforce any provision of these Terms shall not constitute a waiver of such provision or any other provision.

 

 21. SEVERABILITY

 21.1

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

 

 22. GOVERNING LAW AND JURISDICTION

 22.1

These Terms shall be governed by and construed in accordance with the laws of India.

 22.2

Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Gurugram, Haryana, India.

 24. AMENDMENT

 24.2

 24.3

Your continued use of the Platform after such modifications constitutes acceptance of the revised Terms.
